Terms of Use

These Terms govern access to and use of www.calltale.com, the CallTale platform, website scripts, and related services (the “Service”). Our Privacy Policy explains how personal information is handled. The Service is operated by CallTale.com (“CallTale”) (“we,” “us,” or “our”). By creating an account, purchasing, or using the Service, you agree to these Terms. If acting for a business, you represent that you have authority to bind that business.
1. Registration Data, Security, and Passwords
You must be at least 18 years old and legally able to enter into these Terms. Provide accurate account information, protect your credentials, manage access by authorized users, and promptly report suspected unauthorized access. You are responsible for activity by users you authorize.
2. Description of Services
CallTale provides a JavaScript snippet that can replace designated phone numbers on your website with tracking numbers based on available attribution information. Calls to those numbers are forwarded to the destination you configure. A call whisper can play an automated message to the person answering that identifies the attributed source of the call. The Service also records calls and makes recordings available to the relevant customer and its authorized users. The script uses a cookie to recognize a visitor and display the appropriate call tracking number. It does not collect or submit website form entries.
Attribution reflects available tracking information; it does not guarantee a caller’s identity or the precise origin of a lead. Browser restrictions, blocked scripts, privacy choices, shared devices, repeat visits, website changes, number availability, and carrier issues can affect tracking and routing. We do not guarantee any number of calls, leads, sales, or marketing results.
3. Customer Responsibilities
Install the script only on websites you own or are authorized to manage. You are responsible for configuring number replacement, forwarding destinations, and whisper messages; testing the installation; and checking that calls reach the intended recipient. Maintain a working underlying business phone number and remove the script and update published tracking numbers when your use ends.
You are responsible for lawful collection and use of visitor and caller information, appropriate privacy disclosures, and any required consent before activating tracking or other regulated features. Installing the script or accepting these Terms does not establish consent from visitors or callers. Do not place passwords, payment card details, health information, or other sensitive information in tracking URLs, campaign labels, or whisper messages.
Call recording consent: You must ensure callers and answering participants receive appropriate recording notices and that all legally required consents are obtained before recording begins. For calls subject to all-party consent requirements, obtain consent from every participant. A source-identifying whisper to the answering recipient alone is not notice to the caller and does not establish recording consent. If required consent cannot be obtained, the call must not be recorded. You must not use the Service for calls you cannot lawfully record. CallTale remains responsible for its own obligations under applicable law.
4. Conduct and Acceptable Use
Do not use the Service for fraud, harassment, unlawful surveillance, impersonation, spam, unlawful communications, or other illegal activity. Do not interfere with the Service, bypass security or usage restrictions, access another customer’s data without authorization, or use numbers or forwarding destinations without the necessary rights. Call recordings must be used only for lawful business purposes. Any additional features may be subject to additional terms.
5. Tracking Numbers and Emergency Calls
Tracking numbers are assigned for use with the Service, subject to carrier availability and applicable rules. Assignment does not convey ownership. Keeping or transferring a number after cancellation depends on carrier requirements, applicable law, and any written agreement with us. Do not assume a number can be retained or transferred unless confirmed.
Numbers may stop forwarding or be released and reassigned after service ends. You are responsible for updating websites, advertisements, directories, and other materials. CallTale is not an emergency calling service and must not be relied on for emergency communications, including calls to 911.
6. Billing, Renewal, and Cancellation
Fees, included usage, overage rates, billing frequency, and any minimum commitment are stated in your checkout, order form, or service agreement. Payments are processed through Stripe. You authorize charges you expressly agree to, including recurring charges disclosed at enrollment. Recurring subscriptions renew as disclosed at purchase until canceled. You may cancel by informing us in writing through your existing written communication channel with CallTale, or by using the cancellation button in your account if one is present. Cancellation takes effect when your current billing cycle ends and stops future subscription renewals. Charges incurred during the current cycle remain payable. We do not offer refunds, including prorated refunds for unused time, except where required by law.
We will notify you of changes to recurring fees before they take effect. Nonpayment may result in suspension or termination after any required notice. A separately signed service agreement controls if it conflicts with these Terms.
7. Customer Materials and Intellectual Property
You retain your rights in information you submit. You authorize us to process it to provide, secure, and support the Service, as described in our Privacy Policy and any applicable data processing agreement. You represent that you have the rights needed to provide that information.
CallTale and its licensors retain rights in the platform, script, branding, and related materials. Subject to these Terms, we grant you a limited, nonexclusive right to use the Service and install the script during your authorized service period.
8. Third-Party Sites, Providers, and Information
We use Twilio for phone numbers and programmatic call handling, including forwarding, whisper notifications, and recording, and Stripe for billing. Provider outages, restrictions, or changes may affect availability. Their services are subject to applicable provider terms and privacy policies.
9. Suspension and Termination
We may suspend or terminate access for material violations, nonpayment, unlawful use, security threats, or requirements imposed by law or carriers. When practicable, we will give notice and an opportunity to resolve the issue. After termination, access, tracking, forwarding, and whisper functionality may end. Export needed records before cancellation; subsequent retention and deletion are described in the Privacy Policy.
10. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not warrant uninterrupted operation, error-free attribution, or that every call will connect. These disclaimers do not limit warranties or rights that cannot legally be excluded.
11. Limitation of Liability
To the extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential, or punitive damages, including lost profits or business opportunities arising from the Service. CallTale’s aggregate liability arising from these Terms or the Service will not exceed the fees you paid to CallTale during the 12 months preceding the event giving rise to the claim. These limits do not apply to fraud, willful misconduct, or liability that cannot be limited by law.
12. Indemnification
To the extent permitted by law, you agree to defend and indemnify CallTale and its officers, employees, and contractors against third-party claims, damages, and reasonable expenses arising from your unlawful use of the Service, material breach of these Terms, infringement of another party’s rights, or failure to provide legally required notices or obtain required consent. This obligation does not apply to the extent a claim results from our negligence, willful misconduct, or breach of these Terms. We will promptly notify you of covered claims and reasonably cooperate in their defense. You may not settle a claim in a way that imposes an obligation on us without our written consent.
13. Governing Law and International Use
These Terms are governed by the laws of Florida, United States, excluding conflict-of-law rules. Subject to mandatory legal rights, disputes will be brought in the courts located in Pinellas County, Florida, United States. Either party may contact the other to seek informal resolution before filing a claim. Our business is located in St. Petersburg, Florida. We do not offer the Service in the United Kingdom or European Economic Area. Access from other locations does not waive applicable mandatory laws.
14. Changes to These Terms
We may update these Terms and will post the revised effective date. We will provide advance notice of material changes through the Service or your account email. Changes apply prospectively. If you disagree, discontinue use and cancel before the changes take effect. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
15. Notices
Send written cancellation requests and account notices through your existing written communication channel with CallTale. This provision does not replace legal requirements for formal service of process. We may send notices to your account email address or through the Service. Keep your contact information current. Notices concerning material changes will be provided as described above.
16. Events Beyond Reasonable Control
Neither party is responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, government action, widespread internet disruption, or telecommunications outages, except for payment obligations already incurred. The affected party must take reasonable steps to minimize the disruption.
17. Entire Agreement and Miscellaneous
These Terms, applicable order forms, and any separately signed service or data processing agreements constitute the agreement governing the Service. A separately signed agreement prevails in the event of conflict. Nothing in these Terms waives mandatory legal rights. Provisions concerning accrued payment obligations, intellectual property, liability, indemnification, and disputes survive termination to the extent needed to give them effect.
